Ofwat has launched a statutory consultation on changing the charging rules to further protect customers in the new developer services framework.

Ofwat first consulted on the proposals in May 2024. The consultation document also sets out responses to that consultation and the regulator’s decisions in the light of the responses received.
The new consultation relates to the changes Ofwat is proposing to make to its charging rules under the relevant sections of the Water Industry Act 1991 (the Act) as amended by the Water Act 2014. It is the formal, final step before the water sector regulator issues revised rules, to take effect from 1 April 2025.
Specifically, Ofwat is consulting on wording changes to the:
- Charging Rules for New Connection Services (English Undertakers) (ENCR); and
- Common Terms and Worked Examples – English New Connection Rules (CTWE).
The changes will complement the deregulation of certain aspects of developer services Ofwat will implement as part of the Price Review 2024 (PR24), by proposing measures that will offer protection to developer services customers for whom market choice is currently limited.
Ofwat is also consulting separately on its proposed Environmental Incentives Common Framework.
The changes Ofwat proposes to implement relate to water and wastewater companies wholly or mainly in England
